The NSSN Process: Your Path to a Resolution

1. Initial Request & Review
The process begins when one party requests an NSSN session through our platform. At this stage, we:
✔ Review the dispute details, including any past resolution attempts.
✔ Directly engage the other party—making it clear that NSSN is their opportunity to resolve the dispute on their terms, before it escalates further. We explain the process, address concerns, and emphasize that failure to participate means the requesting party may have no choice but to pursue more formal—and costly—legal action. TERC is the last stop before litigation, offering a practical path to resolution while there’s still time to negotiate.
✔ Allow the requesting party to select an NSSN negotiator or have TERC assign one based on the nature of the dispute.
✔ Assess both parties’ positions and goals to create a focused negotiation strategy.
Pre-NSSN Preparation
To ensure a productive negotiation, all parties are required to:
- Complete the provided Pre-NSSN Questionnaire, outlining key issues and desired outcomes.
- Submit all relevant supporting documentation (employment contracts, termination letters, financial records, etc.).
- Familiarize yourself with the NSSN Rules & Guidelines, which will establish expectations for the session.
All documentation must be submitted at least 48 hours before the scheduled NSSN session.
All documentation will remain 100% confidential.
2. The NSSN Session: Negotiation in Action
At the scheduled time, the NSSN session takes place via Zoom, teleconference, or in-person (travel fees apply for in-person meetings).
What to Expect During the NSSN Session:
- Opening Statements – Each party presents their perspective, concerns, and desired outcome.
- Guided Negotiation – The NSSN negotiator works actively with both sides, helping identify common ground and practical solutions.
- Dynamic Problem-Solving – Unlike mediation, which remains neutral, our NSSN negotiators take an engaged role in shaping discussions and keeping parties focused on resolution.
- Agreement Structuring – Throughout the session, the negotiator takes notes of the key resolution points to be included in a final agreement.
The goal of an NSSN session is simple: to broker a deal that works for everyone, without unnecessary legal roadblocks.
3. Resolution & Final Agreement
When an agreement is reached, the NSSN negotiator will:
✔ Draft a resolution summary outlining all agreed-upon terms to be initialed by all parties.
✔ Ensure the parties review and confirm the details before the final agreement is issued.
✔ Will draft the formal agreement to be presented for execution.
The final agreement may include:
- Financial Settlement Terms (severance, unpaid wages, etc.).
- Employment Status Changes (resignation, job modifications, reassignments).
- Confidentiality & Non-Disparagement Clauses (if applicable).
- Release of Claims & Indemnity Agreements (where relevant).
- Other Customized Terms (as agreed upon by the parties).
The agreement is finalized after execution, ensuring clarity, enforceability, and long-term resolution.
What Happens If No Agreement is Reached?
While we work hard to secure a resolution, there are rare cases where an agreement cannot be reached. If this happens:
- Parties leave with a clear understanding of any progress made and of the unresolved issues.
- Future negotiations remain an option, with a NSSN serving as a foundation for continued dialogue.
Even in cases where no final deal is reached, NSSN provides clarity, structure, and a clear next step toward resolution.
